1. Agreement to Terms

By accessing and using GigFlex ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Platform.

These Terms apply to all users of GigFlex, including workers seeking employment opportunities and businesses seeking to hire workers.

2. Description of Service

GigFlex is a digital platform that connects businesses with qualified workers for temporary, part-time, and flexible work opportunities across Canada. Our services include:

• Matching workers with suitable job opportunities
• Facilitating communication between workers and businesses
• Processing payments for completed work
• Providing tools for scheduling and work management
• Background verification and screening services

3. User Accounts and Registration

3.1 Account Creation

To use GigFlex, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Eligibility Requirements

To use our Platform, you must:

• Be at least 18 years old
• Have legal authorization to work in Canada
• Provide valid government-issued identification
• Pass our background verification process
• Agree to these Terms and our Privacy Policy

3.3 Account Security

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Worker Terms

4.1 Independent Contractor Status

Workers using GigFlex are independent contractors, not employees of GigFlex or the businesses they work for through the Platform. Workers are responsible for their own taxes, insurance, and compliance with applicable laws.

4.2 Work Performance

Workers agree to:

• Provide services professionally and competently
• Arrive on time and complete work as agreed
• Follow all safety protocols and workplace rules
• Maintain confidentiality of client information
• Report any issues or incidents immediately

4.3 Payment Terms

Workers will be paid within 24 hours of work completion through our secure payment system. Payment rates are clearly displayed before accepting work. GigFlex reserves the right to withhold payment for incomplete or unsatisfactory work pending resolution.

5. Business Terms

5.1 Business Verification

Businesses must provide valid business registration, insurance coverage, and undergo our verification process before posting jobs.

5.2 Job Postings

When posting jobs, businesses must:

• Provide accurate job descriptions and requirements
• Offer fair compensation that meets minimum wage requirements
• Ensure safe working conditions
• Comply with all applicable employment laws
• Not discriminate based on protected characteristics

5.3 Payment Obligations

Businesses agree to pay workers promptly for completed work. Payment processing fees may apply. Disputes must be reported within 48 hours of work completion.

6. Platform Fees and Payments

GigFlex charges service fees for facilitating connections between workers and businesses. Current fee structures are available on our website and may be updated with notice.

All payments are processed through our secure payment partners. Users are responsible for any applicable taxes on earnings or payments.

7. Prohibited Activities

Users may not:

• Use the Platform for any illegal activities
• Provide false or misleading information
• Circumvent our payment systems
• Harass, abuse, or discriminate against other users
• Interfere with the Platform's operation
• Share account access with others
• Post inappropriate content or spam

8. Liability and Disclaimers

GigFlex provides the Platform "as is" without warranties. We are not responsible for the quality of work performed, workplace injuries, or disputes between users. Users assume all risks associated with their use of the Platform.

Our total liability is limited to the fees paid to us in the preceding 12 months, to the maximum extent permitted by law.

9. Termination

We may suspend or terminate accounts for violations of these Terms or for any reason with notice. Users may terminate their accounts at any time through their account settings.

Upon termination, all outstanding payments will be processed, and access to the Platform will be removed.

10. Governing Law

These Terms are governed by the laws of British Columbia, Canada. Any disputes will be resolved in the courts of British Columbia.

11. Changes to Terms

We may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the new Terms. We will notify users of significant changes.
